Please read this notice carefully. This privacy notice explains how TIAA collects, uses and safeguards information obtained via the TIAA Skill (an explanation of the "TIAA Skill" is more fully described below). For purposes of this privacy notice, when we use the term "TIAA," we are referring to any of the TIAA Companies listed at the end of this privacy notice of which you may be a customer; and when we use the term "TIAA Companies", we are referring to those companies listed at the end of this privacy notice, of which you may or may not be a customer, but because they are affiliated companies, may share information about you in certain circumstances as described in this privacy notice.
This privacy notice applies to you as a user of the TIAA Skill, and is part of the overall TIAA Privacy Policy. To the extent applicable, we protect your privacy in accordance with the Fair Credit Reporting Act ("FCRA"), as amended by the Fair and Accurate Credit Transactions Act of 2003 ("FACT Act"), the Gramm-Leach-Bliley Financial Services Modernization Act ("GLB"), applicable state laws and this privacy notice. By using the TIAA Skill, you indicate your consent to all of the terms of this privacy notice. If you do not agree with the terms of this privacy notice, do not use the TIAA Skill or submit any personal information to us.
The TIAA skill is only available to those who reside within the United States, and shall not be considered as the offer of either goods or services into the European Union.
When you link your TIAA account to the TIAA Skill and set the Alexa PIN, Amazon may collect and use certain data you provide to the TIAA Skill for the purpose of servicing you in accordance with Amazon's Privacy NoticeOpens in a new window and the Alexa's Terms of Use.Opens in a new window TIAA may also collect and use certain data you provide to the TIAA Skill in accordance with the TIAA Privacy Notice.
Amazon may periodically collect and use technical data and related information, including, but not limited to, technical data about your interactions with the TIAA Skill (collectively, "Technical Data") in accordance with Amazon's Privacy Notice and the Alexa's Terms of Use. Amazon's Privacy Policy and the Alexa's Terms of Use are separate from TIAA's policies. TIAA may also periodically collect and use Technical Data to facilitate updates to our services. Technical Data will not personally identify you and TIAA may use it to improve our products or to provide services or technologies to you.
Amazon may retain voice recordings of your interactions with the TIAA Skill as per its Terms of Use.Opens in a new window As discussed further below, the Skill is designed for use exclusively by individuals 18 years old or older. To delete voice recordings, go to "Settings" and follow the instructions. Your TIAA User ID and Password are not visible to or shared with Amazon. Please note that Amazon will not retain a voice recording of your Alexa PIN.
Information We May Collect
The nonpublic personal information we collect through the Skill may include, at a minimum, your TIAA user ID, password, and Alexa PIN, which enable you to sign into your TIAA account through the TIAA Skill, but may also include, if you access certain optional features such as the "Contact Us" feature of the TIAA Skill, your name, telephone number, e-mail address, and state. Additionally, if you use the Request a Callback feature of the TIAA Skill, which enables you to request a call from a TIAA representative, you can elect for the TIAA Skill to collect your contact information from your Alexa rather than manually inputting your contact information for use by the TIAA representative. We urge you to make sure that you are not overheard when logging onto your account.
The TIAA Skill provides you access to your TIAA accounts, and to the extent that you enter any personal financial information, our collection, usage and protection shall be in conformity with all applicable laws governing financial institutions, and in conformity with our overall Privacy Notice and Terms and Conditions. If you submit any personal financial information through the TIAA Skill, the term "personal information" as used throughout this privacy notice shall include any such personal financial information.
The collection, usage and protection of any personal information related to your use of our website, TIAA.org, including via the Skill or mobile application, the creation of your TIAA account or an account with one of the TIAA Companies, any loan from TIAA or any of the TIAA Companies, or an insurance policy through TIAA or any of the TIAA Companies shall be governed by the overall TIAA Privacy Policy.
Technical Data
When you use the TIAA Skill, we may collect and use technical data and related information, including but not limited to technical information about your Alexa, system and application software and peripherals that is gathered periodically to facilitate the provision of software updates, product support and other services to you related to the TIAA Skill. When we use this information, we will only do so in a form that does not personally identify you, to improve our products or to provide services or technologies to you.
How Your Information Is Used
We use your personal information primarily to provide you with the functionality, products and services you request, and we share and use your personal information relating to transactions, balances, payment history and similar experiences among the TIAA Companies to conduct their business. Unless you have told us otherwise pursuant to "Your Right To Opt Out" below, we may also use your personal information to market or determine your possible interest in products and services that the other TIAA Companies offer.
Disclosure of Your Information
We share your personal information with other TIAA Companies as permitted by law. We will not disclose your personal information to anyone outside of the TIAA Companies unless: 1) we have received proper consent from you; 2) we are legally permitted to do so; or 3) we reasonably believe, in good faith, that we are legally required to do so. In order to protect the confidentiality of your personal information, including personal information that we have disclosed to a third party pursuant to this privacy notice, we take appropriate measures, including requiring each third party to execute an appropriate confidentiality agreement governing the use of such information and only allowing access to the information for a limited purpose. For example, we may provide the information to assist us with various aspects of conducting our business, to comply with laws or industry regulations, and/or to effectuate any action that you have requested, including the following:
- Unaffiliated service providers (e.g., fulfillment companies and securities clearinghouses, data processing services, printers and mailing facilities) engaged by us.
- Unaffiliated service providers (e.g., third-party administrators) engaged by your employer.
- Unaffiliated fund and/or insurance companies and their agents whose investment options are made available to you through your employer-sponsored retirement or savings plan, provided monies are allocated to them on your behalf.
- Government agencies, other regulatory bodies and law enforcement officials (e.g., for tax purposes or for reporting suspicious transactions).
- Other organizations, with your consent or as directed by you (e.g., if you use TIAA as a financial reference in applying for credit with another institution).
- Other organizations, as permitted or required by law (e.g., for fraud prevention).
Security of Your Information
TIAA protects the personal information you provide against unauthorized access, disclosure, alteration, destruction, loss, or misuse. Your personal information is protected by physical, electronic, and procedural safeguards in accordance with federal and state standards. These safeguards include appropriate procedures for access and use of electronic data, provisions for the secure transmission of sensitive personal information through the TIAA Skill and our website, and telephone system authentication procedures. Additionally, we limit access to your personal information to those TIAA employees and agents who need your personal information in order to offer and provide products or services to you. We also require our service providers to protect your personal information by utilizing the privacy and security safeguards required by law.
However, as discussed further below, the security of Alexa itself is not under our control nor do we accept responsibility for it, and you assume any risks with using Alexa to access your accounts with us.
Your Right to Opt Out
Providing us with access to your information permits us to offer you distinct advantages and better service. It enables us to provide you with more comprehensive financial guidance. Sharing and using your information helps us tailor product offerings to you and eliminate those that may not interest you.
Federal law gives you the right to limit some but not all sharing of your personal information. You may not limit sharing of information of your transactions and experiences with TIAA Companies, but you may limit sharing of information about your creditworthiness.
Unless you tell us otherwise, (i) TIAA may share information about your creditworthiness with other TIAA Companies or (ii) other TIAA Companies may use your personal information for marketing purposes. If you are a Vermont resident, state law gives you an additional right: we will not share information about your creditworthiness with other TIAA Companies except with your consent.
If you do not want TIAA to share information about your creditworthiness with other TIAA Companies or other TIAA Companies to use your personal financial information for marketing purposes, you may simply let us know by opting out. If you opt out, TIAA may still notify you of its new products or services. Please note that we cannot withdraw any previous disclosures made with your authorization.
To opt out of either information sharing or marketing, or both, please call the National Contact Center weekdays, 8 a.m. to 10 p.m. and Saturday, 9 a.m. to 6 p.m. (ET) at 877-518-9161. You may receive more than one privacy notice from the TIAA Companies depending on the products you own.
If you own a life insurance contract, brokerage account or a TIAA-CREF Funds account with a co-owner, you and the co-owner may:
- Opt out separately, or
- Either of you may opt out for both of you
If you opt out separately, we will limit disclosure of information only for the owner who has opted out. If you indicate that you are opting out for the co-owner as well, we will limit disclosure for both of you.
Your opt-out becomes effective as soon as practicable. It remains in effect until you revoke it in writing. No further action is needed. Even if you have opted out, you will receive our privacy notice as required by law.
Children's Privacy Online
TIAA encourages protection of children's information on the internet. The TIAA Skill, which is another means of accessing our services, is not directed toward children. The TIAA Skill is designed for use by individuals 18 years old or older, and we do not knowingly collect or post information from children under the age of 13. We may ask for date of birth only for account verification purposes, and only on the telephone.
Changes in Our Privacy Notice
TIAA periodically reviews its policies. We reserve the right to amend them. If we amend this privacy notice, we will continue our commitment to maintaining the security and privacy of your personal information. We will notify you of material changes prior to when they take effect through a banner notice in our website, TIAA.org
How to Change or Correct Your Personal Information
You may change your personal information using the TIAA Skill or by one of our phone numbers which you can find on our website. Note that certain changes cannot be processed over the phone. You may need to update your information for various different accounts you hold through TIAA through separate means.
For Nevada residents, state law requires that we provide you notice that you have the option to be placed on our Internal Do Not Call list. If you would rather not receive marketing calls from us, please call us at the telephone number provided above.
Former Customers
If your customer relationship with TIAA ends, we will not destroy your personal information unless required or permitted by law. We will continue to treat your personal information in accordance with this privacy notice and applicable laws.
Internet Tracking Disclosure
We do not have the protocol that offers you the choice to opt out of Internet tracking. You may reset your web browser to enable do not track signals if your web browser supports such functionality.
The TIAA Companies
As described in this notice, "TIAA", the "TIAA Companies" or "we" are financial companies using the TIAA and/or Nuveen brands that share a corporate identity. TIAA Companies include but are not limited to the following:
- Teachers Insurance and Annuity Association of America and TIAA-CREF Life Insurance Company (TIAA Life) are insurance companies. They provide products such as life insurance and annuities.
- College Retirement Equities Fund (CREF) is an investment company that is the companion organization to TIAA. CREF provides retirement annuities.
- TIAA-CREF Funds is an investment company.
- TIAA-CREF Life Funds is an investment company.
- Teachers Advisors, LLC., is an investment adviser. It provides services for our mutual funds and personal annuities.
- TIAA-CREF Investment Management, LLC, is the investment adviser to CREF.
- Teachers Personal Investors Services, Inc. (TPIS), is the principal underwriter for TIAA-CREF Funds and TIAA-CREF Life Funds and has interest in tuition savings products.
- TIAA-CREF Individual & Institutional Services, LLC, is the principal underwriter for CREF and the TIAA Real Estate Account and is authorized by agreement to sell and service TIAA-CREF Funds, TIAA-CREF Life Funds, and interests in tuition savings products. It also provides brokerage accounts through TIAA-CREF Brokerage Services.
- TIAA, FSB, is a federally chartered savings bank. Through its TIAA Trust division, it provides asset management and fiduciary services for individuals and institutions and acts as custodian and trustee for individual retirement accounts; and through its TIAA Bank division, it provides full-service, nationwide banking and lending services to consumer, commercial and institutional clients through a variety of channels, including online, its Florida-based financial centers and at other business offices throughout the country. End-user agreement
Teachers Insurance Association of America, TIAA-CREF Individual & Institutional Services, LLC, TIAA, FSB and their subsidiaries and affiliates listed in the TIAA Privacy Notice (collectively, "TIAA") make available to you software, application or services that allow you to access, use and view your TIAA accounts ("The TIAA Skill") via Alexa ("Alexa").
The TIAA Skill is a voice-driven capability that enables you to access certain information about your TIAA online account ("TIAA account") on devices that connect to the Alexa Voice Service ("Alexa"), like the Amazon Echo, Amazon Echo Show, Amazon Dot, Amazon Tap and Amazon Fire TV ("Connected Devices"). Once you have enabled the TIAA Skill, you will be able to verbally ask Alexa to assist with a number of actions, which may, from time to time, include locating an ATM, checking your account balance, transferring funds internally and externally, and making a payment. All functions may not be available at all times, and we are under no obligation to notify you of any changes in functionality.
When you make a request to the TIAA Skill (a "User Request"), you will receive a voice response from the TIAA Skill (a "TIAA Response"), and a record of the voice interaction (an "Alexa Card") may appear in the Alexa companion app (the "Alexa App"), and if you are utilizing an Amazon Echo Show, a separate record of the voice interaction may appear on the device display (the "Alexa Display").
The TIAA Skill is not set up to respond to customer service requests, and the TIAA Skill has limited ability to respond to any free-form audio messages at this time. Please do not send us messages through Alexa unless the message is an audio command that the TIAA Skill is programmed to recognize. The TIAA Skill is not intended to be used to dispute a transaction on your TIAA account.

Please read the Terms and Conditions of this End-User Agreement ("Terms of Use") carefully before using the TIAA Skill. By using the TIAA Skill, you agree to follow and be bound by these Terms of Use. Nothing contained in these Terms of Use is intended to modify or amend any other written agreement, including any customer or account agreements, and any other agreements that govern your brokerage account, bank accounts, pension accounts and any other accounts you may have with a TIAA company (individually, an "Account" and collectively, the "Accounts"), or your use of information, content, tools, products and services available on and through TIAA.org and the TIAA Skill. If you use 360 Financial View in TIAA.org, the 360 Financial View Terms and Conditions apply to the 360 Financial View functionality in the TIAA Skill as well and they are incorporated herein by reference. TIAA may modify, suspend, discontinue, or restrict the use and availability of any portion of the TIAA Skill at any time, without notice or liability. Individual access and use of the TIAA Skill may be monitored by TIAA and used for TIAA's internal business purposes, without liability. You can get more information about information that we collect from use of the TIAA Skill by consulting the TIAA Privacy Policy.
The information, content, tools, products and services of the TIAA Skill are owned by TIAA, and depending upon the information may be owned by certain third party content provider(s), as more fully described, below. These Terms of Use also include some important disclosures and information related to certain products and services offered by TIAA, and its affiliates and subsidiaries.
TIAA may periodically modify these Terms of Use, and any modifications will be effective immediately upon posting. You should periodically check these Terms of Use for any changes or modifications. If you do not agree to these Terms of Use, do not use the TIAA Skill. By continuing the use of the TIAA Skill, you agree to any changes or modifications to the Terms and Conditions.
Limited License and Restrictions on Use
TIAA grants you a limited, revocable, nonexclusive, nontransferable license to view, store, bookmark, download and print the pages within the TIAA Skill solely for your personal, informational, and non-commercial use, or as expressly authorized by TIAA in writing. Accordingly, you understand this is a limited license to use the TIAA Skill and you agree not to: (i) modify, copy, distribute, forward, transmit, post, display, perform, reproduce, publish, broadcast, license, create derivative works from, transfer, sell, or exploit any reports, data, information, content, software, RSS and podcast feeds, products, services, or other materials on, generated by, or obtained from the TIAA Skill, whether through links or otherwise (collectively, "Materials"); (ii) attempt to probe, scan, or test the vulnerability of any Materials, services, systems, networks, servers, or accounts related to the TIAA Skill or attempt to gain unauthorized access to Materials, services, systems, networks, servers, or accounts connected or associated with the TIAA Skill through hacking, password or data mining, or any other means of circumventing any access-limiting, user authentication or security device of any Materials, services, systems, networks, servers, or accounts related to the TIAA Skill, or redeliver, reproduce, or circumvent any page, text, image, or materials on the TIAA Skill; (iii) modify, copy, obscure, remove, or display TIAA's name, logo, trademarks, text, notices, or images without TIAA's express written permission; and (iv) use Alexa, software, or a routine that could interfere with the proper working of the TIAA Skill, that could damage or disable the TIAA Skill, any systems, networks, servers, accounts, Materials or services provided through the TIAA Skill, or that would interfere with any other party's use of the TIAA Skill. You are responsible for obtaining and maintaining all equipment, services, and other materials that you need to access the TIAA Skill. TIAA reserves all rights not expressly granted in these Terms of Use.
Eligibility
- The TIAA Skill is only available for individuals who reside in the United State of America and have active TIAA accounts and who have a valid TIAA User ID and Password that provide TIAA account access at TIAA.org.
- The TIAA Skill is intended for individual TIAA account owners who are at least eighteen (18) years of age or older.
TIAA Skill Authorizations
- You can get account information and engage in transactions only when you have linked your TIAA account to the TIAA Skill
- When you choose to check your TIAA account balance using TIAA Skill, your TIAA account balance may reflect pending transactions such as deposits or withdrawals. Pending transactions have been temporarily authorized but may not yet be finally posted against your TIAA account. There may be limitations on the number of transactions that are accessible to you through the TIAA Skill.
- Account information you receive from the TIAA Skill does not replace or act as your account statement. In the event there are any inconsistencies between such information and your account statement, your account statement governs and reflects the appropriate transactions.
- If you choose to make a bill payment using the TIAA Skill, you authorize us to enable and process such payment in accordance with our standard processes and procedures, including, without limitation, drawing funds from the bank account(s) associated with bill payment in your TIAA account.
Data Sharing and Usage
- TIAA will share TIAA Responses, Alexa Cards, and Alexa Displays with Amazon only for the purpose of responding to your User Requests.
- This information may include the last five (5) digits of your TIAA account(s), balance in TIAA accounts, and most recent transactions. Such information will remain subject to the TIAA Privacy Notice, and Amazon may only use such information to service you.
- TIAA may use the address configured in the Alexa Companion App or on display enabled Alexa devices to support location-based services that you may request from the TIAA Skill, such as the location of ATM machines. TIAA will use your address in accordance with the TIAA Privacy Notice.
- Your User Requests, such as "check my balance," or "make a payment," will remain subject to the TIAA Privacy Notice, and Amazon may only use such information to service you and to enhance their voice services and capabilities.
- Amazon may de-identify your User Requests, which will not identify you as an individual or as a TIAA Account(s) owner, and use them in accordance with Amazon's Privacy NoticeOpens in a new window and Alexa Terms of Use.Opens in a new window
Security
It is solely your responsibility to maintain the physical security of your Alexa Devices and the personal devices you use to access the Alexa App and the confidentiality of the information and services accessible through your Alexa Devices, personal devices and the Alexa App.
You should keep your Alexa Devices, personal devices and your TIAA User ID and Password, your Amazon user ID and password, your Alexa PIN and other credentials secure in the same manner as you would keep secure your cash, checks, credit cards, and other personal identification numbers and passwords that you wish to keep private and confidential.
Anyone with whom you share your Alexa Devices, your personal devices, your TIAA User ID and Password, your Amazon user ID and password, and/or Alexa PIN may be able to use the TIAA Skill and/or the Alexa App and have access to information and services to which you have access via Alexa. Any such individual shall be deemed an authorized user who is using Amazon, Alexa and/or the TIAA Skill (as the case may be) with your consent. We recommend that you not share such credentials with anyone whom you would not wish to have access to your private information, your TIAA account or any TIAA account information. Take care to ensure that no one overhears your private information, including your Alexa PIN, as you interact with the TIAA Skill. Remember that you must unlink your TIAA Account(s) and delete your history under "Settings" in the Alexa App prior to sharing or transferring your personal devices or giving access to your Amazon account or Alexa Devices to another.
We recommend that you always use available security and lock features on your personal devices. If you do not utilize the lock screen feature of your personal devices or log out of the Alexa App, the messages and other information contained in the Alexa App, including the Alexa Cards, may be accessible to anyone with access to your personal devices.
Please note that all information on your Alexa Display will be accessible to anyone who can see your Echo Show. However, such information will only be displayed for up to 30 seconds.
We also recommend that you do not speak any sensitive personal information or ask Alexa to speak any sensitive personal information, without ensuring that you are not overheard.
To help avoid any unauthorized access to your personal information, particularly in the event you believe: (1) someone has gained unauthorized access to your Amazon account, an Alexa Device or a personal device or your TIAA User ID or Password, Amazon user ID or password or Alexa PIN; or (2) your device or credentials have been or may be lost, stolen or otherwise compromised in any way, you should immediately:
- disable the TIAA Skill;
- change your compromised credentials, and
- notify the party issuing your compromised credentials (in the case of TIAA, call us).
You agree to notify us immediately if you suspect fraudulent, unauthorized or abusive activity relating to your TIAA account(s).
Third Party Agreements
Amazon and your Alexa Device, and other third party services or sites incorporated in Amazon or linked to or through the TIAA Skill, have their own terms and conditions and privacy policies and practices (collectively, "Third Party Agreements"). You may be subject to these Third Party Agreements when you use the TIAA Skill, give these third parties your personal information, or otherwise use their services or visit their respective mobile platforms or websites. It is your responsibility to review and accept all applicable Third Party Agreements before using the TIAA Skill.
TIAA is not responsible for the security, accuracy, legality, appropriateness or any other aspect of the content or functionality of Amazon, Alexa, any device or any third party's products or services (whether or not related) that may be incorporated or linkable from the TIAA Skill.
We are not responsible for, and do not provide, any support or assistance for any third party hardware, software or other products or services. If you have any questions or issues with a third party product or service, please contact the appropriate third party in accordance with its procedures for customer support. If you have any questions or issues pertaining to Alexa (other than questions or issues specific to the use of the TIAA Skill), please contact Amazon.
While TIAA does not currently charge a fee for your use of the TIAA Skill, you will be responsible for all fees that may be imposed by non-TIAA parties in connection with such use (such as data usage charges) and subject to any restrictions those third parties may impose. You will also be responsible for any fees for any services conducted through the TIAA Skill, in accordance with the applicable account agreements for your TIAA Accounts. Further, you agree to pay all internet charges, cellular telephone carrier fees, or other fees incurred by you in accessing the TIAA Skill.
Third Party Content
The TIAA Skill includes general information, interactive tools, and data concerning the financial markets, securities and other subjects. Some of this content is supplied by companies that are not affiliated with TIAA ("Third Party Content").
Third Party Content is available through framed areas, or is simply published on the TIAA Skill. The Third Party Content is protected by copyright pursuant to United States laws and international treaties and is owned or licensed by the Third Party Content provider(s) credited.
TIAA has not been involved in the preparation, adoption or editing of Third Party Content and does not explicitly or implicitly endorse or approve such content. The Third Party Content providers may not implicitly or explicitly endorse or approve how the Third Party Content is used, nor do they give investment advice, or advocate the purchase or sale of any security or investment.
While TIAA makes every attempt to provide accurate and timely information to serve the needs of users, neither TIAA nor any Third Party Content provider guarantees the accuracy, timeliness, completeness or usefulness of the Third Party Content, and neither TIAA nor any Third Party Content provider are responsible or liable for any such content. The Materials on the TIAA Skill are for information, education, and noncommercial purposes only, are presented as of the date published or indicated, and may be superseded by subsequent market events or for other reasons.
The TIAA Skill is not intended to provide legal, tax, investment or insurance advice. Nothing on the TIAA Skill should be construed as an offer to sell, a solicitation of an offer to buy, or a recommendation for any security by TIAA or any third party.
Risks Associated with Trading Using TIAA Skill
Due to the nature of developing technology, you should be aware of the following risks related to the TIAA Skill and trading:
- The TIAA Skill services may not allow the same functionality, access to information and services which are available when not using the TIAA Skill.
- Due to the nature of Alexa, we do not warrant that the operation of the TIAA Skill services will be uninterrupted or entirely error-free. For example, due to service connectivity or internet connection difficulties endemic with applications, the service may, from time to time, be subject to delay, error or failure, with results that include, but are not limited to, the following:
- an inability for you to engage in transactions ;
- the services delivering inaccurate information including price and/or quote information;
- delay in receipt of information by us from your Alexa or from us to your Alexa;
- a failure of your Alexa to receive any messages from us; or you erroneously believing that you have placed an order when our records show that we have not accepted an order from you.
- Your interaction with Alexa may be overheard by third parties.
There may be other risks associated with the use of the TIAA Skill. In no event shall TIAA be liable for damages in excess of your actual loss due to our failure to complete a transaction or fulfill a request, and TIAA will not be liable for any incidental or consequential damages.
Because of the limits of wireless transmissions, your order, instruction, or request may not be received as quickly as it would if placed through your computer or other access channels. It is possible that a connection or function may not be available when using the TIAA Skill or is interrupted, or that a feature can be disabled, when attempting to conduct a financial transaction. Should this happen, review your transaction status to verify the status of the attempted transaction when you have access to a computer, or contact a TIAA representative by telephone.
Portfolio Values
If you ask for the value of your portfolios and accounts or a specific account, the date and time of when the account values are updated may vary depending upon the type of account. Some accounts may updated only once a day and other account values may be updated intraday. We recommend that you access your account online to see when the account value was last updated. You should also be aware that not all accounts may be reflected in the portfolio value that is spoken.
Additional Terms (to the extent applicable)
Quotes and Valuation:
Order Entry screens provide or display real-time quotes if your account is eligible, and you have agreed to the Real-Time Quote Agreement. All other pages display delayed quotes and should not be relied on for pricing and trading.
For valuation, delayed quotes using the last price are used for domestic equities and options only. Pricing of other positions is as of the previous day's close or the most recently available price. If an equity security has not traded today, the valuation is based on the best bid price from the previous business day. The current bid or ask may be different from the price displayed. Securities pricing may vary from actual liquidation value. Prices provided or shown should only be used as a general guide to portfolio value. Your printed confirmations and statements are the official records of your account.
Prices for mutual funds are not updated until after market close (usually between 7pm ET and 10pm ET). Until the prices are updated, Change and Change(%) for mutual fund holdings is based on the difference between the prior two business days' Closing Prices. These values reflect the effect of market fluctuations on the Market Value of a mutual fund. Recent mutual fund activity such as a purchase or sale will not affect these values, but may result in these values not accurately reflecting the effect of market fluctuations on the account in which it is held. These values are not included for calculating the total 'Change in Market Value'.
Intraday Holdings do not account for orders that are executed but have not yet been reported by the exchanges/market makers. Please check your orders before placing trades.
Order Change or Cancellation Requests:
You understand and acknowledge that confirmations of executions or cancellations may be delayed or may be erroneous (e.g. due to computer system issues) or may be cancelled/adjusted by an exchange, market center or executing broker. Any reporting or posting errors, including errors in reporting or posting execution prices or cancellations, will be corrected to reflect what actually occurred in the marketplace.
You understand and acknowledge that when you place a request to cancel an order, the cancellation of that order is not guaranteed. The order will only be cancelled if the request is received by the market center to which the order was routed and matched with the order to be canceled before it is executed. During market hours, it is rarely possible to cancel market orders or marketable limit orders as such orders are subject to immediate execution. You should not assume that any order has been executed or canceled until you have received a transaction or cancellation confirmation.
You acknowledge and agree that TIAA is entitled to assume that any instruction transmitted via Alexa using your account details has been transmitted by you or by a person duly authorized by you and is at your risk. Therefore, TIAA has the absolute authority to effect any instruction made via Alexa, where the requisite account and password information in relation to your account has been provided. You must immediately inform us if you are aware or suspect that a third party has had access to your username, account number or password or if you suspect that any person other than you or any duly authorized third party is dealing on your account. You also acknowledge and agree that TIAA is entitled to decline to process any instruction transmitted via the TIAA Skill and Alexa using your account details in its sole discretion, if TIAA suspects fraud, unauthorized use or for any other reason.
If, as a result of the error or failure of the TIAA Skill service that is out of our control, our internal records are at variance with your TIAA Skill records or own recollection, the version of events supported by our records will prevail and any obligations on either party shall be assessed on the basis that our internal records are correct.
We do not accept any liability for damage to your Alexa or for any loss of functionality that results from your use of the TIAA Skill and you agree that you will not attempt to hold TIAA liable for any such damage or loss of functionality.
Although TIAA will not charge you additional fees for using the TIAA Skill, you may be charged by your internet service provider for data network usage. Because the TIAA Skill provides access to real-time streaming quotes, you understand that TIAA recommends that you obtain an unlimited data plan from your internet service provider.
TIAA may require you to update your version of the TIAA Skill at any time. While we will attempt to retain your personal settings and preferences, there is still the possibility that they may be lost.
As part of the TIAA Skill, you may receive notifications, text messages, alerts, or other types of messages sent to you outside or inside the TIAA Skill. You have control over settings for such notifications, and can opt in or out through the TIAA Skill or through your Alexa App (with the exception of Urgent Notifications). Please be aware that messaging fees may apply depending on the message plan you have with your wireless carrier.
You hereby represent and warrant (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
Account Authorization and Use
If you have an account or plan to open an account with TIAA, you agree to provide TIAA with current, complete, and accurate information about you as prompted by the applicable registration process and agree to regularly update this information to maintain its completeness and accuracy. You agree to use the TIAA Skill to access only those accounts on which you are authorized to act, and to use your own user names, logins and passwords when accessing accounts on which you are authorized to act.
Foreign Persons
The TIAA Skill and the Materials on the TIAA Skill are intended to be made available only to individuals who reside in the United States. Because of the global nature of the Internet, you agree to comply with all local rules with respect to your account and your online conduct, including all laws, rules, codes, and regulations of the country in which you reside and the country from which you access the TIAA Skill, including without limitation, all laws, rules, codes, regulations, decrees, acts, orders, directives, legislation, bills, and statutes pertaining to tax, contracts, intellectual property, securities, e-commerce, banking, technology, computers, fraud, and privacy. In addition, you agree to comply with all applicable laws, rules, codes, and regulations regarding the transmission of technical data exported from the United States.
Nothing on the TIAA Skill shall be considered a solicitation to buy, or an offer to sell, a security or any other product or service, to any person in any jurisdiction where such offer, solicitation, purchase or sale would be unlawful under the laws of such jurisdiction. In addition, nothing on the TIAA Skill shall be considered either an offer of goods or services in the European Union.
Disclaimer of Warranties
TIAA DOES NOT MAKE ANY EXPRESS OR IMPLIED WARRANTIES OF ANY KIND ABOUT THE TIAA SKILL, INCLUDING WITHOUT LIMITATION ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. THE TIAA SKILL IS MADE AVAILABLE TO YOU "AS IS" AND "AS AVAILABLE" AND TIAA DOES NOT WARRANT THAT ANY DEFECTS OR INACCURACIES WILL BE CORRECTED.
TIAA DOES NOT WARRANT THAT THE TIAA SKILL WILL MEET YOUR NEEDS, OR THAT IT WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE. TIAA ALSO MAKES NO WARRANTY THAT THE RESULTS OBTAINED FROM THE USE OF THE TIAA SKILL WILL BE ACCURATE OR RELIABLE, OR THAT THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE TIAA SKILL WILL MEET YOUR EXPECTATIONS.
Limitation of Liability
TIAA WILL NOT BE LIABLE TO YOU OR ANYONE ELSE FOR ANY CONSEQUENTIAL, INCIDENTAL, SPECIAL, DIRECT, OR INDIRECT DAMAGES (INCLUDING BUT NOT LIMITED TO LOST PROFITS, TRADING LOSSES OR DAMAGES THAT RESULT FROM USE OR LOSS OF USE OF THE TIAA SKILL AND THIRD PARTY CONTENT, INCONVENIENCE OR DELAY). THIS IS TRUE EVEN IF TIAA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OR LOSSES.
TIAA WILL NOT BE LIABLE TO YOU OR ANYONE ELSE FOR ANY LOSS RESULTING FROM A CAUSE OVER WHICH TIAA DOES NOT HAVE DIRECT CONTROL. THIS INCLUDES FAILURE OF ELECTRONIC OR MECHANICAL EQUIPMENT OR COMMUNICATIONS LINES (INCLUDING TELEPHONE, CABLE AND INTERNET), UNAUTHORIZED ACCESS, VIRUSES, THEFT, OPERATOR ERRORS, SEVERE OR EXTRAORDINARY WEATHER (INCLUDING FLOOD, EARTHQUAKE, OR OTHER ACTS OF GOD), FIRE, WAR, INSURRECTION, TERRORIST ACT, RIOT, LABOR DISPUTE AND OTHER LABOR PROBLEMS, ACCIDENT, EMERGENCY OR A GOVERNMENT ACTION.
IF YOU LIVE IN A STATE THAT DOES NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY OR INCIDENTAL OR CONSEQUENTIAL DAMAGES, OR IF YOU ACCESS THE TIAA SKILL SOLELY THROUGH AN ARRANGEMENT WITH YOUR EMPLOYER OR PLAN SPONSOR, SOME OR ALL OF THESE LIMITATIONS AND EXCLUSIONS MAY NOT APPLY TO YOU.
ANY MATERIALS DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE TIAA SKILL ARE DONE AT YOUR OWN RISK. YOU ARE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR OTHER EQUIPMENT, OR LOSS OF DATA THAT RESULTS FROM SUCH DOWNLOAD.
Indemnification
As a condition of your use of the TIAA Skill, you agree to indemnify and hold TIAA and each Third Party Content provider harmless from and against any and all claims, losses, liability, costs and expenses (including but not limited to attorneys' fees) arising from your use of the TIAA Skill, or from your violation of these Terms of Use.
Termination
The rights granted to you herein terminate immediately upon any violation by you of these Terms of Use. TIAA, in its sole discretion, reserves the right to temporarily or permanently terminate your access to and use of the TIAA Skill at any time and for any reason whatsoever, without notice or liability. TIAA will not be liable to you or any third party for any termination of your access to or use of the TIAA Skill.
Governing Law
Unless otherwise agreed, these Terms of Use and their enforcement are governed by the laws of the State of New York, without regard to conflicts of law, and shall inure to the benefit of TIAA's successors and assigns, whether by merger, consolidation, or otherwise.
Miscellaneous
If any of these terms of use are found to be void and/or otherwise unenforceable, then a court shall endeavor to give effect to the intentions reflected in the invalid provision and the rest of the terms will be upheld between the parties. These terms of use shall be construed under the laws of the State of New York and any suit under them shall be proper in venue and jurisdiction in the federal and/or state courts located in New York, New York. These are the complete terms relating to the Service. Neither party will be held responsible for delays in service caused by Force Majeure events. All claims relating to the Service must be raised within one year of such claims arising or be forever barred. Our failure to exercise or enforce any right or provision of these Terms will not constitute a waiver of such right or provision.
We reserve the right to correct any error(s) with secure access inquiries and transactions.
